Can’t claim quota in another state unless notified: HC

A Backward Class student in one state cannot claim reservation under the same quota in another state unless his community is notified in that state too, the Madras HC has ruled.

Dismissing a petition by a medical seat aspirant from Rajasthan, who had migrated to Tamil Nadu 15 years ago, the HC said, “The petitioner’s community did not find a place in the list of BC categories published in Tamil Nadu Under Article 15 of the Constitution”.

Saying that only members of a backward community identified by the state government have the benefit of quota, the court said the petitioner did not “carry the criteria of socio-economic backwardness identified by Tamil Nadu.”
