Sri Lanka's jailed former Army Commander Sarath Fonseka withdrew an application against the appointments of the judges into the second military tribunal against him.
The counsels appearing for the ex-Army Commander informed the Supreme Court that another case has been filed in a lower court on the same matter.
The appeal asked the court to annul the second court martial verdict claiming that the procedure of appointing judges to the court martial was biased.
The three-member panel of judges led by the Chief Justice, Shirani Bandaranaike, allowed the lawyers to withdraw the petition and later rejected it without granting permission to proceed.
