Prison authorities failed to produce Fonseka in courts on time on May 03 for the hearing of a petition he filed against removing him from the parliamentary seat of Colombo district following his 30-month rigorous imprisonment sentence imposed by the court martial.
The Commissioner General of Prisons cited the several minutes delay on last Tuesday was due to traffic.
Supreme Court postponed the hearing of the petition for today and ordered the Commissioner General of Prisons to appear in court to show cause.
At today's hearing of the petition, Romesh de Silva, the counsel appearing for the ex-Army Commander stated that the court martial sentence against his client had not been endorsed by the President as required by law.
Further hearing of the petition was postponed to June 07.
Another petition filed by Fonseka against the judges of the court martial was also taken for hearing today and it was postponed to May 25 since the objections of the defense had not been received by the petitioner's party.
