The Madras high court has stayed the release of Tamil film, Kaavalan, starring Vijay and Asin. The film was slated for release in a couple of weeks.
Justice S Rajeswaran, admitting a civil suit filed by the Singapore-based Tantra Incorporated Private Limited on Wednesday, stayed the release of the film for a period of six weeks.
In its application, Tantra said that it had entered into an agreement with the Ekaveera Creations of Chennai on September 29 for distribution/exhibition of the film all over the world, except Tamil Nadu. The total consideration for the rights was Rs 5.5 crore. It was also agreed that the producer would not sell or pledge the rights to anyone else without the knowledge of Tantra.
As per the scheduled payment, Rs 1.5 crore was paid to the producer in two instalments, the Singapore company said, adding that they were also issued a letter of confirmation for the film rights.
While so, Tantra sought certain clarification with regard to the reported attempt to sell the global distribution rights to another company. The producer did not give a proper reply, it said.
Tantra said that on November 18 the producer sent a letter threatening to cancel the agreement. Claiming that it was ready to pay the remaining amount as per the agreed terms, Tantra wanted the court to restrain the producer from releasing the film.
Justice Rajeswaran, recording the undertaking of the Singapore company to pay up the remaining amount, said: "In the light of the above (undertaking), I am satisfied that a prima facie case has been made out. Hence there will be an order of interim injunction for a period of 6 weeks."
